The Role of Weapon in Muharabah

One of the issues concerning Muharabah is the role of using weapon. Utilizing the method of data analysis, this article proposes a new categorization of the data. According to the common viewpoint of Imami jurists utilization of weapon plays a great role in the concept of Muharabah. Article 279 of Islamic criminal law of Iran (enacted in 1392 H) confirm this view. Conversely, some scholars see the weapon only as a means not a nesesssary component of Muharabah. This article study the veiwpoints of both sides and their arguments which are mostly based on hadiths. The results show that using weapon has no role in the concept of Muharabah and it is merely a common means used in such cases.
