The Executor of Child Discipline; A Jurisprudential Investigation
The Concept of discipline, according to its application in jurists’ words, has two meanings: correcting with punishment as a duty of parents or teachers, and taʿzir. Referring to the first-hand sources and with a critical analytical method, this article tries to specify who is responsible for executing child discipline according to fiqh and Islamic jurisprudence. The results of this study show that although there are different opinions about this issue, but one can conclude form fiqhi sources that infallible Imams, the religious Hakim, the father, the attorney, the wasi and the teacher of a child can discipline him/her for his/her immoral behaviors. But teachers’ right is restricted to the cases related to education.
