Analysis of Criminological Foundations of Criminal Responsibility

Abstract:
States, as the main actors in the international arena, are the guarantors of order and security, but sometimes they may commit crimes and cause insecurity and disorder. Nevertheless, despite the efforts of the International Law Commission, today, the criminal responsibility of states, in terms of domestic international law has not been accepted and this causes impunity of state crimes. Given this vacuum, it is possible to use some criminological approaches to determine the criminal responsibility of states as legal persons. Preventing labeling against citizens, preventing human rights violations, preventing harm to people, protecting victims and the right of people to cope with criminal states are the criminological foundations of this issue that the present article by analyzing these foundations, concludes that today in accordance with these principles, the international community must recognize the criminal responsibility of states so that international or regional judicial bodies can administer justice about criminal states.
