Abstract:
Legal entities are divided into two categories: public and private. The Islamic Penal Code according to it, in materials 20 and 143 somewhat describes the punishment and the extent of their criminal responsibility, While these institutions have a distinct personality from government agencies and legal entities. On this basis, this research is descriptive-analytical and studies the nature of these persons, the criminal responsibility and how to apply each of the penalties in Article 20 of the Islamic Penal Code. At the end it was concluded that professional private institutions have not characteristics of government agencies and legal entities, rather, they are intermediary and they should be considered a new entity. Therefore, legislators should be exempt from punishment in cases of public mission, and in other cases specifying the penalties applicable is necessary.
