Islamic Republic of Iran’s Legislative Reaction towards Terrorist natural persons and legal persons
With more than 17000 terror victims, I.R.IRAN is one of the biggest victims of terror and the Iran is one of the main advocates of countering terrorism. Despite this fact, a closer look at Iranian criminal law shows that terrorism has not been recognized as a crime so far. Since legislation is affected by such factors as an emerging social dilemma or a neglected crime in the current law, studying causes of lacking such legislation and the government’s policy towards it is taken as a research area. Based on documentative study, this research is a descriptive analytical one, concluding that some hudud and tazirat in Islamic jurisprudence adapt to the recognition of terrorism as some samples of crime and this is one reason for hesitation in the criminalization of this phenomenon in Iran. However, about the possibility of criminalizing organizations and companies as terrorists, a lack of legislation were found. Furthermore, due to the necessity of a common language between Iranian criminal law and the international system, the Islamic Republic of Iran has to resolve the problem of scattered legislation, develop the quality as well as the quantity of legislation, criminalize it and pass a comprehensive law for countering terrorism.
