The effect of prison in preventing the recurrence of crime and its role in correcting and rehabilitating offendersEmphasizing on dangerous criminals in Iran's legislative criminal policy
Iran's legislative criminal policy towards prisons and its role in the correction and rehabilitation of dangerous criminals is the subject of this article. In the Iranian legal system, under the influence of transnational human rights documents, the issue of reform and rehabilitation of criminals, including dangerous criminals, has undergone changes from before the revolution until today, which have led to the humanization and excellence of criminals' rights. The traditional system of correction and rehabilitation recommended prevention and treatment only through the imposition of punishment, but new criminological findings have raised the issue of the return of criminals to society.
In this research, the author has described the subject in a descriptive-analytical manner.
Although under the influence of strict legislative, judicial and executive policies that became a common paradigm of the criminal justice system in the West in the nineties, strictness and non-return to society are the reason for the existence and focus of the criminal policy system. But with the defeat of this idea, under the influence of new perspectives on human rights in order to reform and rehabilitate offenders, the domestic laws of countries also underwent a dramatic change. Influenced by other transnational laws in the second generation of human rights, human dignity and respect for the rights of prisoners at the top of the pyramid of the criminal justice system and humanized the view and action to protect the rights of prisoners.
