Procedure Regarding Performance of agency in Divorce Cases

The husband grants authority to the wife to get divorced and the wife initiated a claim for permission to exercise the notarial deed of agency. Arak court of first instance and the appellate court of the Central Province heard the above case and rendered a judgment accordingly.The 16th branch of the Supreme Court of the country has considered this case with the wife's authority as a case brought by the husband against the wife and has twice disagreed with the judgment of the appellate court of the Central Province and as a result, the case has been raised in the General Board of the Supreme Court.The aforementioned General Board considered such a case as a case brought by the principal (wife) against the agent (husband) and upheld the judgment of the provincial appellate court. Such an interpretation regarding the case is not compatible with the relevant statutes and is therefore criticized in this article.
