The position of the Guardian Jurist in applying Islamic rules to the requirements of time and place

Abstract:
Muslims agree on the finality, eternity and universality of the rules of Islamic law. Also the Shiite jurists believe that the divine commandments are based on real expediency and corruption. so there is no obligations unless there is expediency in it, and there is no prohibition unless the practice is corrupt. so the fundamental question arises that if due to a major change in lifestyle, a ruling loses its practical expediency or an obligation causes corruption, is it possible to change it permanently or temporarily by Guardian Jurist who is in charge of the Islamic society? In this study, we seek to answer how much of the Islamic rules can be changed and adapted to the requirements of modern society. Therefore, we examined the position of the Supreme Leader in the eyes of Imami jurists and came to the conclusion that the Supreme Leader, due to his special position in the Islamic society, can change governmental and judicial rulings, harmful rulings and also personal ruling temporary and permanent to the requirements of time and place, without being against to the immortality and perfection of the religion of Islam, but on the contrary, it is a kind of guarantee for it.
