Family Law in the Mirror of Modernity and Islamic Lifestyle

The lifestyle of the Iranian family has been based on religious and national identity, but modernity has affected most societies, including Islamic Iran, which has resulted in the emergence of a conflict between the religious, national and modern identities and has led to the emergence of Challenges in lifestyle in the field of family and the causes of damages due to non-application of Islamic lifestyle. This article examines the effects of modernity on the Islamic way of life in the field of family law. And answering the question of possibility of interaction between Islamic lifestyle and modernity.

The present study has been done by library-citation method and analysis in the form of qualitative (descriptive-analytical) content analysis.

The findings of the study indicate that the effects of modernity on lifestyle in the challenge of individuality, definite celibacy, consensual divorce, rejection of arbitration in divorce, heavy dowry and obtaining the right of divorce instead of the dowry, unwillingness to have children, the challenge in The wardship of children is emerging. The teachings of Islam use the Qur'anic spirit and innate and rational philosophy as a criterion in the lifestyle and do not negate the totality of modernity. In the interaction of modernity and the Islamic lifestyle in the field of family, the mentioned component should be evaluated.

The teachings of Islam place the Qur'anic spirit and natural and rational philosophy in the standard of living and do not negate the totality of modernity. It means, any new identity that is found in the field of family, if it complies with the Islamic identity in accordance with the Quranic spirit, will not cause conflict with the Islamic lifestyle, since all Islamic rules in the area of family are based on divine, innate, rational and understandable. In the interaction of modernity and Islamic lifestyle in the area of family, the mentioned component should be the criterion of evaluation. In fact, instead of matching the totality of modernity with the whole Islamic lifestyle, the components of Islamic lifestyle should be the criterion of evaluating the modernity. An Islamic family should be based on the Islamic lifestyle.
