survey on Leadership of Supreme Jurisprudent Source Theory, based on late Imam Khomeini's (PBUH) thoughts

Due to the status of the Supreme Source of Jurisprudence in Islamic system,Leadership of Supreme Jurisprudent Source (Velayat-e-Faqhih) Theory hasa great significance in Islam, and in the Constitution of the Islamic Republicof Iran. Therefore, the author has in this article after presenting the definitionsand idiomatic meaning related to Velayat-e-Faqhih, and entering a discussionon branches of “Vilayah” (leadership; guardianship; friendship…) intendedto elaborate on its status in each of those divisions. Pointing out that based onvarious classification systems, Velayat-e-Faqhih is among accredited types ofleaderships and is valid in the field of issuing religious decrees, or decrees basedon Islamic Jurisprudence. He then surveys the background of this theory inviewpoints of sources of jurisprudence.The author finally focuses on necessity of the establishment of an Islamicsystem, which in turn leads to the necessity of having an Islamic ruler at its top,stressing that the late Imam Khomeini (PBUH) has highlighted that significantpoint, stressing that it is quite a “self-evident matter”. He then lists the authoritiesof the Supreme Source of Jurisprudence, highlighting the point that the barriersof that source in a political administration and is that of a a political and spiritualleader, that are the same as the Holy Prophet’s (PBUH) authorities, and those ofthe Infallible Imams (PBUT).He finally focuses on the issue of expediency in the Islamic system
