The authority of common law from the Islamic sect's viewpoint

The term “common law and convention” plays a practical and effective role in the process of deducing rules in Islamic sects. In this article, the authority of common law will be studied in two chapters from different perspectives. The term “common law and convention” and its differences with intellectual proof are studied in first chapter. The second chapter will deal with the comparative study of Twelvers (Shiite) and Sunnite outlook and qualifications, common law proofs and freewill in principal sources of Islamic sects.
