A Prelude to the Sunnite Legal Formulas (From origination to establishment)

Legal formulas can be reckoned as one major part or rather pillar of the Sunnitefiqh. The significance of these formulas is known to all legal experts and to thoseinterested in the inferring laws from their resources. Many books have already beencompiled on the issue and still many are being added to them. There are many like Suyuti who hold that one fails to learn fiqh, to know the secrets of shari’a, or to master the skills of legal reasoning, if one disregards these formulas.Although there are very few resources on the subject and those few are hard to havean access to, this paper is an effort to present “A prelude to the Sunnite legal formulas”as a step in the course of knowing such formulas. The concept of “comparativejurisprudence” would be no more than an illusion, if we did not set such issues fordiscussion. Furthermore, the recognition of such issues would help for a deeperunderstanding and scrutiny in the Shiite fiqh and realizing the pros and cons of it.
