Reliability and Gathering of Electronic Evidences in Criminal Law of Iran

Abstract:

As the information technology permeates into all dimensions of the human life and influences the legal domain, the issue of the documents prepared as a result of applications of this technology is also realized. The most important part of the investigations concerning the electronic technology relates to the positive proofs. The traditional law has faced new challenges due to the expansion of the modern technologies; that is, judicial authorities have come across numerous problems in the investigation, inquisition and gathering of proofs since some invisible and intangible proofs in the arena of electronic technology and information technology replace the tangible and concrete proofs. Electronic proofs have different reflections as compared with other proofs provided in the physical world and they require new rules and policies due to their unique characteristics. That is why the issue of the positive proofs, gathering them and protecting their integrity and credibility for the purpose of submitting them to judicial proceedings is of special importance.
