Agheleh (Criminal's Sponsors) in the Jurisprudential System of Islam

Agheleh is one of the important topics in the law system of Islam.It is also referred to as those who would accept the repayment of blood-money(compensation) instead of the criminal equally such as his/her male paternal/maternal consanguine or relatives and acquaintances respectively according to the relative heirs. The guarantee of the sponsors or supporters is a kind of familial insurance and a social support which means the existence of compensation is entailed on Agheleh as a kind of support or sponsor. The present paper is mainly interested in revealing the statutes of Agheleh and how its problems are discussed in jurisprudence.The author benefits from using different softwares and data from the school of the Household (S.A.) and from various jurisprudential books and sources as well as law and tradition sources such as Sheikh Toosi and Imam Khomaini's Tahrir-ol-Vasila. The article proceeds to study the historical background of the Agheleh guarantee of Pre Islamic period and of the Time of Ignorance when the Prophet(PBUH) was approved of. Finally,the paper seeks to investigate the quest of Agheleh based on the early jurists as well as the Islamic penal/punishment law.
