Manteghat-al-Faragh as a Theory of Legislation

The studies concerning legislation, recently transfer from political science to public law. there are too many ideas distributed in heritage of Shia jurisprudence about that. It is essential to discover and use them to solve the problems related to constitutional law of Islamic Republic of Iran as a religious political system. One of the most important of them is the Theory of Shahid Sayyid Muhammad Baqir al-Sadr known as Manteghat-al-faragh. The goal of this paper is verifying his ideas about legislation as a coherent theory, so that could be an equivalent for theories of legislation in secular political systems. So, it is tried to explain these ideas as a theory with more focus on rules legislated in Manteghat-al-faragh that have more similarity with modern concept of legislation.
