A Reflection on the Concept of Right and Implementation of Right With a View to the Iranian Nuclear Issue and Geneva Agreement

negotiations between the Islamic Republic of Iran and 5+1 is a package of legal, political and international security issues understanding of which would not be possible unless all these aspects are taken into consideration. From the legal perspective, the entitlement of a right defers from the implementation of right. These two concepts are not necessarily born together. This article argues that the Islamic Republic of Iran has not negotiated its nuclear rights with 5+1. These negotiations are being conducted in order to conclude an agreement having a clear time frame and exclusively on the methods of implementing nuclear rights by Iran with view to building international confidence on the Iranian peaceful nuclear program.The Geneva Joint Plan of Action agreed between the parties, has not prejudiced the right of the Islamic republic of Iran to enjoy fully its right for a peaceful nuclear program. The commitments of the Islamic Republic of Iran in this joint plan are subject to two qualifications namely “time frame” and “Voluntary acts” which are also clear indications that Iran has not compromised its inalienable nuclear rights. In authors’ point of view the Geneva agreement not only has not undermined the Iranian nuclear rights but also has strengthened the Iranian rights including the right to enrich uranium. The comprehensive long term agreement which will be discussed between the parties in upcoming meetings would be able to make the Iranian nuclear achievements more tenacious and contribute to Iranian national interest in the other aspects.
