A Study of Legitimacy of Canonical Tricks in Usury Transactions With special Reference to Imam Khomeini's Approach

Abstract:
Canonical trick means finding a way to evade opposition to the biding law and decree of the Sharia, putting its bottlenecks behind or preventing the implementation of a binding decree. Normally those who play such tricks, aim to avoid commitment of an unlawful act or put a canonical bottleneck behind. There are differences of opinion about the lawfulness of use of canonical tricks and the permitted kinds of tricks. Among the most important usages of trick is playing trick in the field of usury, which takes place in the forms of transactional usury and loan usury. The present paper is an attempt to study the application of trick in transactional usury and its legality with special reference to Imam Khomeini’s viewpoints.
