The Validity of Future Contracts from the Perspective of Imamiah Jurisprudence

Abstract:
Standard futures contract is a kind of fulfillment requirements of pledge in future which hase been standardized according to the exchange frameworks. In such contracts, a financial bond is received- either sale or buying in future- for assurance of fulfillment of a mandate which is transferred upon on predefined procedures between the two accounts of parties of a contract. The validity of usage of future contracts as a new contractual entity is to be confirmed by law specialists. This will notbe achieved unless in due attention to premises of Imamiah jurisprudence and the existing rules. The methodology is library study. In the present survey, after investigation and acceptance of the principle of contractual freedom in Imamiah Sect, associated subjects and answering to some discussed issues on these contracts- having gambling characteristics, lack of transaction intention, un-decidability, exploiting non-authorized properties, etc.- it was concluded that such contracts are confirmed by Imamiah Sect and associated premises. So, using such contracts is not legally and Shari ah Prohibited.
