Methodology of comparative studies in the Islamic Fiqh

The comparative Fiqh is a scientific method which is applied for comparing Fiqh religions and describing and explaining commonalities and their differences. The Fiqh researcher, in this approach transcends from the fences of sources, arguments and ways of understanding in a special religion and provides for a detailed understanding of the issue under research within perspectives and different tools. To do comparative studies in the Islamic Fiqh, he goes through stages: 1. Finding issues and knowing issues 2. Determining a scope of comparison, 3. Presenting hypotheses and extracting of similarities and differences in the views in reference to basics and reasons, 5. Explaining similarities and differences in Fiqh views, are among the major stages in the comparative stages in the Islamic Fiqh.
