Comparative study of the right and obligation in views of Islam and the international community

Abstract:
The purpose of this paper is to explain the relationship between the right and obligation, in Islamic view and contemporary international law. The relationship between the right andobligation is one of the controversial issues among thinkers in the philosophy. The main question is that, what is the relationship between rights and obligation? The Islamic scholars and Western lawyers have given different answers to this question. In view of international community contrary to the Islam, the contemporary era is known as the transition period of Obligation. In the world of modernism should speake about right and no obligation. This article examines the concepts of the right and obligation and the relationship between the right and obligation in Islam and the contemporary international community, in the framework of the theory of «separation of the right and obligation» and concomitance of the right and obligation by descriptive and analytical method.
