What is the Philosophy of Jurisprudence

1. As the philosophy of fiqh seems to be a new emerging science, our perspective of the nature of philosophy of jurisprudence can be of a great help for the formation and orientation of the debate.2. The philosophy of fiqh is a second order philosophy and one of main sources of controversy in its limits and the way it should be explained. This controversy results from the limitations in these sciences in general.3. Eight definitions are presented for the philosophy of jurisprudence and taking the views of each theorist into account, the merits, and flaws of each definition is spelt out.4. The relation between the philosophy of jurisprudence and other homogeneous disciplines such as theology, rejal, derayah and particularly usul-e-fiqh is discussed and it’s examined that whether there is any overlapping between them. If yes, then will this overlapping hamper the formation of a new discipline as the philosophy of jurisprudence?
