Realization of No mahr is for adulteress rule in Iran's law system

One of the juridical rules that many scholars in various juridical fields referred to that, but so far has not been studied independently as a juridical rule in the books of rules, the rule of "No mahr is for adulteress" is the rule means that the adulteress shall not be entitled to dowry (mahr). In this paper, we explain the main characteristics and the inherent universality and legitimacy of a juridical rule, it is proven that the verdict "No mahr is for adulteress" can be described as a juridical rule and could be studied. On this base, considering the method which is usual for studding juridical rules, first the meaning of this rule is explained and realized that the “mahr” in this sentence means “similar dowry” and “baqi” means adulteress and this rule generally means that the adulteress has no any right for her adultery. Then it is studied the penetrations of this rule to Iran`s law structure, specially criminal law and civil law and with saying the scholars different sights, it is resulted that criminal law in sentencing to not paying the compensate of hymen in cases that defloration was with consent and sexual entrance and also in sentencing to not paying mahr in cases which “efdha” was by consent and sexual entrance is based on "No mahr is for adulteress" rule. Furthermore it is realized from the concept of article 1099 from civil law that sentencing to not paying mahr to adulteress is based on this rule.
