Criminal Purposes (Maqasid) of Sharia

If, indeed, in the inference of Sharia decrees, the will and purpose of God being excluded and it leads to the wrath of God which thereby prevents the revelation of heavenly and earthly blessings, as Imam al-Sadiq (A.S.) warned about it, it is necessary to recognize the certain objectives of Sharia and definitive purposes of legislator as Ijtihadic reasons and controlling factors in Ijtihad. And the effort and scientific rigor that we use in other fields of jurisprudence and the sciences related to Fiqh should be also common in identification of the legislator's intentions and the purposes (Maqasid) of Sharia. This means that, more than ever, we guide and conduct our capacities, abilities and talents in this direction, thinking of essential mechanisms and try to study and investigate purposes, examples and related cases. This paper is an attempt in this direction, however elementary; trying to enter into the recognition of definite purposes of Sharia in matters related to criminal law.
