Analysis and Examination of Non-Verbal Evidences of the Necessity of the Formation of a Religious Government from Ayatollah Mostafa Khomeini’s Perspective, Centered on the Treatise on “the Authority of the Qualified Faqih”

Among the important axes in the discussion of “the authority of the qualified faqih” is the subject of “the necessity of forming a government by faqihs”, which is based on believing the issue of “political authority of the jurisprudent”. This subject has been reflected widely in Seyyed Mostafa Khomeini’s ‘the Treatise of the Authority of a qualified faqih”. In this paper, with a descriptive=analytic approach, we have examined the non-verbal evidences of the necessity of forming a religious government from his perspective. Among the evidences he has based his discussion to prove the necessity of formation of a religious government by a qualified faqih is inference from the Infallibles’ way of life, knowledge of religious principles, the consensus of Muslims, the principle of prudence, the principle of gambling and successive order, the principle of justice. Apart from the rational reasons, along with a series of analytic discussions, he has spoken about the functions of prophetic mission and prophecy and analyzed the essential Islamic laws and believed that since all Divine leaders including prophets and the Imams all have been sent to govern human societies, it is impossible to conceive of this duty as aborted and unnecessary in the absence of the Imam.
