Cosmetic surgery from the perspective of jurisprudence

Abstract:
Cosmetic surgery is one of the emerging issues in jurisprudence. Although it had not been presented in its current form in the past, the roots of the discussion are available in our religious texts and sources of jurisprudence. The jurisprudential ruling of cosmetic surgery is examined from two perspectives: primary ruling and secondary ruling. According to the primary ruling, most of the Imamieh jurists believe that it is Mobah (permissible) and some of them believe it is Haram (forbidden). Those who believe it’s Mobah refer to the proofs such as Isalat Al-Ibahah and the Rule of Domination. Those who believe it’s Haram according to the primary ruling of cosmetic surgery, are referring to some evidence like keeping the self away from harm and damages, changing the creation of God, believing in God being the true owner. In some of the secondary rulings, it is ruled that cosmetic surgery is Mobah. Rational intention, urgency, necessity, hardship, importance and expediency are some of the secondary rulings that prove the cosmetic surgery license. In some cases, although it is ruled that cosmetic surgery is Mobah according to primary rulings, the jurists have ruled that it is Haram based on the secondary rulings. Some of these secondary rulings which can be mentioned are touching and Haram glance, deceiving, pride, prodigality and harm.
