Nationality and Gender: A Gender-Based Perspective on the Children's Nationality in the Iranian Laws

Abstract:
The difference between the patrilineal and matrilineal roles in terms of granting theIranian nationality by birth and subordinate nationality to the children in the Iraniannationality laws has led those whose perspective on the legal issues is a genderbased view to condemn the Iranian nationality laws to the gender discrimination, asa whole, or at least, in the mentioned cases and they are seeking a modification ofthe current laws with an equality-based orientation (often feminist orientation). Aftera logical analysis of related logical materials and thinking of mentioned perspective,this article concludes: First, the legal system of Iranian nationality is not based onthe difference and in many cases, it is based on the equality; second, in the cases ofdifference, such as mentioned cases, the difference does not have a gender nature;third, the mentioned differences are not based on logical and convincingfoundations, so it is important to modify the laws by logical-legal solutions
