The Principle of Priority of ethics on Law in the scope of Family Law

Abstract:
Family, ethics, and law are three words that cannot be imagined without each other. Perhaps at first it would seem that law can play a fundamental role in the family, but managing family relationships is morally more than just law. Accordingly, method of this research is descriptive-analytic and try to answer this question, what does the principle of ethical precedence on law in the family mean and what is the role of the legislator in providing this principle? It seems that this principle means that, as long as ethics can offer appropriate solutions in solving problems in the family, so it is precedence on law. To enforce this principle in the family, the legislator needs to provide appropriate legal arrangements, such as the adoption of laws to require early marriage counseling and education, and the necessary training for couples, to comply both with the principle of the preference for treatment on prevention, and couples will be prevented from prosecuting courts and filling lawsuits.
