Intelligence Jurisprudence and Human Rights

Jurisprudence traces the real path of human life on the basis of materials, real interests, and the requirement of creation, and that’s why jurisprudence has considered the security as other human necessities. Human rights have long been considered in the text of monotheistic culture and religions, and in different areas there are many examples that follow the same principle in political jurisprudence, security jurisprudence, economic jurisprudence, intelligence jurisprudence, and so on. In this regard, the attitude towards human rights from the perspective of information jurisprudence means believing in a divine source for it. Because a religion-based perception of rights creates a guarantee for its implementation, in addition to the guarantee of government performances, consideration of the eternal rewards and punishments for those who observe and abuse the human rights, in the field of intelligence activities, provides a specific support in terms of enforcement of the rights. The study of human rights from the intelligence jurisprudence’s point of view , is the study of the religious and normative orders for intelligence officers in conducting intelligence and security operations in dealing with human rights. In this regard, while considering the issue of human rights in the context of jurisprudence, the researcher tries to explain its normative outline in the field of human rights in the areas of intelligence and security activities
