Abstract:

The spread of terrorism and continuation of human rights violation make people regardless of living in their land and place of residence looking forward safety and freedom in the other lands. International law let people who has well -founded fear of persecution and chasing in their countries to asylum to other countries, but there is no task to accept refugee. This analytical-descriptive research shows that, the asylum seeker is responsible for proof of physical aspect. Totally the contrast of rule -based traditional national rights and approach of human rights in asylum process is visible. Some norms like guiding or helping refugees to third country or provide opportunities for entrance permission to third state will reduce traditional approach intensity. In fact the international correlation approach that is mentioned in the New-York declaration 2016, tries to establish significant balance between person ‘right to refugee and sovereign right of destination state. In this case you cannot ignore the role of international institution like United Nations High Commissioner for Refugees.
