Considerations and Components of Fair Hearing in the Light of the Legal System of the Islamic Republic of Iran

Purposeful research is part of the problem-based applied research and is an analytical one using documentary method to collect data and information through study of books, fundamental research and articles, and consider the considerations and dimensions of fair trial. Studying the rules and standards of fair trial showed that in terms of the citizenship-based laws of the sacred law that the Iranian criminal justice system has taken to enforce it, the necessity of maintaining the general order of national sovereignty and the rules of jurisdiction are among the most important considerations of fair trial. These include the respect for the principle of equality and justice, the rule of law, the rule of law, the protection of victims, the defendant and society, human dignity and the prevention of judicial errors. Therefore, a fair trial can be exercised with respect to all legal and ethical guarantees, thereby preventing the defendants' rights from being undermined and other role-makers in the criminal process. However, the principles of fair trial have always been taken into account in the laws of the Islamic Republic of Iran.
