Analysis of the evidences governing on the validity of transfer of human body components

One of the legal issues that involves the transfer of various human components the problem is the possibility of the transaction of these components and the fixation of change on it. In the legal system of Iran, buying and selling is one of the customize consideration contracts. In addition to the Basic conditions of transactions integrity, it is essential that there is a relationship between human with his body parts Such as Property, Occupancy, or at least, it can be applied under reasons of accuracy buying and selling or practical principles, in order to justify the authorization and influence of the transaction. Then, possession of human in his body be coused permitting of the transfer of parts and accessories of his body to other needy people, wether sale or gratuitous selling. Because of the prevention of illegitimate and inhumane use of humans,and thus eliminating human dignity and respect, therefore, should be gratuitous selling be replaced for sale, or that sales of human body components are carried out under the supervision of legal authorities. In the present study, it is attempted to analysis the arguments and jurisprudential and legal principles governing on the validity of this issue.
