The Basis of State Succession to Obligations in respect of International Wrongful Acts

Abstract:

Succession of states to obligations in respect of international wrongful acts, is in the scope of succession to international responsibility which there are very different opinions about that. Here, a state should be considered in its general meaning. Applying descriptive-analytical method, the present paper is seeking to finding the basis regarding state succession to obligations in respect of international wrongful acts and in accordance with that, it explains the concept of the principle of non-transmission, as the basis on which the advocators of non-succession of states to obligations in respect of international wrongful acts have relied on it and then it addresses the principle of continuance as the basis on which the advocators of of state succession to such obligations relied on. In spite of all the dissenting views that, speccially in classsic thoughts in international law, have been issued, the article in hands, comes to this conclusion that there is no impediment in front of state succession to obligations in respect of international wrongful acts, in international law to prevent the transferring of obligations in respect of international wrongful acts. Scrutinizing these bases is the subject of the present paper.
