The Duties of Mabtun and Maslus Pilgrims in Hajj and Umrah

Abstract:

The study of the rulings of the worship acts that physically-excused pilgrims of Hajj and Umrah perform is one of the major and innovative jurisprudential concerns. Being mabtun or maslus describes a condition in which man cannot control his urine or feces. Some acts of worship in Hajj and Umrah such as prayer, Ṭawaf, and Ṭawaf prayer are difficult for these excused people to perform. This article will use evidence to determine the jurisprudential rulings of these pilgrims’ worship acts. Since the excused pilgrims’ justifications vary, they are subjected to distinct rulings, which will be discussed here following the documentary and logical evaluation of the narrations. Regarding the ruling on Tawaf, while, some issue fatwas on the necessity of hiring an agent to perform Tawaf on behalf of the excused pilgrim besides his own performance, the evidence finds this agency unnecessary. Also, with regards to Tawaf prayer and the necessity of renewing ablution, jurisprudents provide different ideas; despite the precaution of renewing ablution, examining the evidence finds it unnecessary.
