Abstract:

The right to a healthy and safe environment has been enshrined as a fundamental human right and has been reflected in various international instruments. In Iranian law, the right to a healthy environment has been considered in the constitution, which according to Article 50 of the Constitution in the Islamic Republic, the protection of the environment of today and future generations should have a growing social life, is considered a public duty. Nowadays, the application of restorative justice in environmental crimes has received a lot of attention because environmental restoration has always been one of the concerns of legal activists in this field. The aim of this study was to investigate the process of restorative justice in environmental crimes and the challenges that exist in this field. Restorative justice programs, because they are based on dialogue and exchange of views, feelings and experiences of the perpetrators of the crime, provide an opportunity for the offender to realize that the techniques he is using are not very correct and even some of them are based on misconceptions. And it's wrong.
