Combating Piracy in the Light of the Convention against Transnational Organized Crime (Palermo 2000)

The most important convention on piracy is the 1982 Convention on the Law of the Sea. However, due to the year of its drafting, this convention faces many limitations in establishing an appropriate legal framework to deal with the "new piracy", which is clearly different from its predecessors. It remains to be seen whether the Convention against Transnational Organized Crime 2000 can provide an appropriate legal framework for combating modern piracy.

The research method in this research is descriptive-analytical.

In this research, the originality of the texts, honesty and trustworthiness have been observed.

The piracy that has been taking place on international waterways in recent years is different from the past, both in terms of how it occurs and in terms of the targets and even the areas where the attacks took place. Do not have it. Therefore, as the UN Security Council has insisted in some of its resolutions, it is essential that the provisions of other international instruments be used to fill the gaps.

The 2000 Convention against Transnational Organized Crime is one of the most important international instruments for this purpose. But to take advantage of the provisions of this document, it must first be seen whether, in essence, the crime of piracy can be considered a "transnational organized crime" as defined by the Convention. And if the answer to this question is yes, it should be considered what benefits or benefits can be obtained from this international document to deal with modern piracy as effectively as possible.
