Ecocide, from the historical background to the law; a future-oriented study
In the pursuit of a better life, man has always attacked the environment and caused many damages, some of which are irreparable. For a long time, humans have believed that the environment was created for the use and benefit of humans, although the cause of its destruction was also caused by humans. Although efforts have been made in the past few decades to protect this valuable treasure and the heritage of future generations by raising awareness, establishing laws and applying some restrictions; However, the serious and widespread damage caused to the environment by governments and multinational companies in a systematic and organized manner has resulted in extensive violations of fundamental human rights. This is also the reason for the close connection between human rights crimes and environmental crimes; Therefore, it seems that one of the basic conditions for maintaining human rights is protecting the environment against environmental crimes. Ecocide is one of the most important environmental crimes that arose from the destructive and violent war of the United States against Vietnam. The efforts of environmentalists over the past few decades to criminalize this destructive human behavior have been unsuccessful due to the influence of multinational companies and the unwillingness of governments to recognize this crime. In this research, which is presented in a descriptive-analytical and library method, by looking at the historical and legislative process of ecocide and analyzing environmental crimes from the perspective of green, ecological and environmental criminology, while identifying the perpetrators of this crime, the need to criminalize ecocide has been attempted. be emphasized.
