One of the basic ideals of Islam has been to implement justice in the society. Therefore, the initial core of an institution called dîvân-i qaḍâ (judiciary council) was gradually formed in the field of Islamic rule, and developed with the expansion of Islamic civilization. However, this institution has not been sufficiently examined in view of its structureand theoretical considerations and as to what changes it has undergone in its development course. In this article, the process of the structural and theoretical developments of this institution in early centuries of Islam is examined and the way it functions is analyzed.
