Commandments of canonical law in the mirror of masnavi-e- molavi
Based on the classification of mohaggeg-e- Helli in 'sharaye-olislam' in which issues of canonical law have been divided into for sections of prayers, transaction, unilateral lagal contracts (igaat) and commandments, this paper deals only with commandments. Afterproviding explanations and examination of canonical law, this paper investigates Molavi's viewpoint, about hunting and slaughter, usurpation, inheritance, judgment, penalties and punishments, error of judge, retribution and blood money.The majority of viewpoints of molavi with respect to cnonical law are in conformity with the weel-know views of jurisprudents. In some instances, Molavi's openion corresponds withe openios of canonical law of Sonni jurisprudent, and sometimes with those of shiithejurisprudents. Sometimes, it seems that he has an exclusive viewpoit of canonical law which is not compatible with any sects. However, based on the investigations carried out, it was concluded that a common point could be reached in this openions and other decrees of canonical law through principles for interpreting the laws and throughscientific and other decress of canonical law theogh principles for interpreting the laws and through scientific and logical justification. Nevertheless, it is undeniable that in rare instances, Molavi's viewpoint does not correspond with Well-know opinion of jurisprudents. Of course, this is demanded by the nature of personal understanding and 'legal theorization' (ijtehad).
