Competition Law and Defending Market Integration in Shiite Jurisprudence

Abstract:
Achieving prospective goals of the market is contingent upon the existence of a series of institutions or that of a process termed as competition the outstanding feature of which is economic freedom. The result of this process is creation of motives and mechanisms desirable for economic growth through innovations and initiatives. In this process of institutional atmosphere, free behavior of economic activists and consumers is not completely predictable. Thus supplying newer and less expensive products by competitors is considered a serious threat. The outcome of this situation is allocative and productive efficiency and increase of the welfare of the consumer. This article argues that the existence of the transactions system and strengthening its institutions is a necessary expedience from the perspective of Shiite jurisprudents. So it is one of the important duties of Muslim ruler to defend the integration of the market through setting regulations of competition law. This law is a reasonable mechanism towards defending the integration of funding market versus those who intend to limit transaction freedoms using the market power, and to change the direction of market rules towards personal interests or arbitrary goals.
