The legal and jurisprudential study of marriage portion (Mahr) of the non-intercoursed Muslim wife
Marriage is an old humane costume that Islam has confirmed some of its customary rules. This strong contract entails some financial and non-financial consequences. One of the rights of women in constitution and stabilization of family is marriage portion (Mahr). Half of the agreed Mahr becomes certain just as the contract is made and the other half after a complete sexual intercourse between the couples. The present paper which is a descriptive-analytic research answers this important question that if the wife converts to Islam but the husband is still Non-Muslim, whether the annulment of the marriage due to conversion of the woman to Islam expires her Mahr and makes her as a subject to the rule of action against self or she has the right to half of her Mahr? The finding of the present paper unlike the viewpoint of majority of the jurists is that the Muslim wife has the right to her Mahr.
