Legal Pathology Decentralization of Tehran in Light of Government employees Departure from Tehran Regulation
During recent decades several plans were executed by previous government for decentralization of Tehran that in spite of spending expensive costs, still such plans were not applicable and successful; in which, the most important plan was leaving governmental employees from Tehran. Not only this plan was failure for obtaining imaged goals, but also it violated several legal principles including: Principle of sovereignty of law, observing hierarchy of legal rules, observing border between legislation and execution, focusing on qualifications of legislator, fundamental freedom of people, freedom for selecting residence, freedom for selecting location of employment and also this plan was executed by executive power in short scale and finally it was nullified by High Administrative Court. In the present article we examine this issue from pathological point of view; since, generally we believe that through preventing from early development of legislative inflation; it is also necessary to execute available rules decentralization rules and preventing from executing non- expert plans; since, finding solution for problems of Tehran goes beyond applying quasi- legislative and governmental rules.
