The Compensation for Unlawful Arrest and Wrongful Accusation with Emphasis on the Code of Criminal Procedure 92

All human beings are born free and if they were not, no benefit would be provided for him from his wisdom and reason side, and also no worldly and heavenly penalty. Several verses of Holy Quran refer to the dignity and superiority of humans on earth. In the constitution of the Islamic Republic of Iran, the third chapter, including Principles 19-42, entitled "Rights of the Nation", some laws and rights have been laid down. Freedom is one of the most important blessings and precious rights of man which is also one of the most controversial issues during the ages.One of the types of freedom is the liberation of the human body, according to which a person can travel, come, sit, rise, settle or stay wherever he wants to…, no one has the right to stop him except in cases provided for by law. By using library sources, this descriptive paper will examine the innovation of the Code of Criminal Procedure 92 and also investigate the compensation for unlawful arrest in the Code of Criminal Procedure 92. The results show that the laws have been changed in this procedure including the development of custodial and removal of temporary detention.
