Legal Analysis of Digital Currency with Emphasis on Its Impacts on National Security
Nowadays, the significant growth of digital currencies has drawn too much attention to this phenomenon. In this regard, the legal analysis and how the legislators make policy as to this issue has become one of the main concerns of researchers in this field. One of the most important legal issues of digital currency is the analysis of its legal nature and also how the prevalence of these currencies affect the national security of the country. In this article, we have attempted to explain the nature of these currencies, how other countries treated them, and also how the Iranian legislator dealt with them. Then, we tried to examine how the prevalence of these currencies will affect the national security of the country. It seems that our legislator has not adopted any law regarding the digital currencies just like the conservative countries; it has taken a similar position to China as it has practically banned banks and financial and credit institutions from trading digital currencies. However, the lack of proper legislation in this area has left an open door to the negative effects on national security; It is because the prevalence of digital currencies requires the observation of asset control mechanisms. Therefore, the non-compliance with these requirements will damage the country’s economic system as a result of money laundering crimes and compromise the country to terrorism because of committing the crime of financing terrorism.
