The Criterion for Virginity and Non virginity in the Light of Terminology, Jurisprudence, and Iransmission

Since Non virginity and virginity have been designated in some Iransmission on the subject ground of reason, and regarding the ambiguities in understanding these two terms among the terminologists and consequently the jurisprudents, the necessity of examining these two words is crucial. Regarding this issue, the criterion for distinguishing virginity and Non virginity is highlighted as the main objective of the present study. It aims to elaborate that in which case the virgin girl is excluded from the title of virgin; hence considered to be as a Sayyeb and subsequently the jurisprudential verdicts allocated to her will change. Considering the application of the word "virgin", and especially Non virginity in the narrator's queries, the present study not only intends to emphasize the necessity to understand the literal and conventional meaning of these two terms, but also aims to highlight the importance of examining whether the criterion of Non virginity from law perspective is the same as the lexical criterion or not. The ideas of lexicologists is different regarding the meanings of  virgin and Sayyeb; consequently, many jurists who regard literal meaning as the religious standard for these two terms have ended in disagreement. It seems that by analyzing the viewpoint of lexicologists one can understand the real meaning of these two words in order to refer other meanings to this same real meaning. Moreover, by examining narratives from various dimensions, one can find that although in most jurisprudential issues, lexical criterion is accepted by law, on the issue of the permission of the guardian for marriage of a virgin, there are multiple categories of narratives, the combination of which makes the religious outlook to be different from the conventional custom.
