Jurisprudential-Legal Remedies for Surmounting Marriage Suspension

In Islamic jurisprudence as well as in Iranian law, the right to divorce is allocated to husbands, and this decree on judicial divorce along with the implementation of attorney is assigned to the fulfillment of one of the conditions of marriage. Judicial divorce cases are circumscribed in laws, and the subject of Article 1130 of the civil law is merely involved with hardship and discomfort imposed on a wife. Similarly, in courts procedure, the case for the foresaid issue has been sufficed to absolute certitude. Hence, one of the cases where courts can grant the right to divorce to a wife without the consent of the husband is the assumption that the husband abandoned the wife without a justified legal reason or as interpreted in Qur'an "suspends" her. However, according to the narrative in Kafi’s text which is regarded as a document for some jurists’ Fatwas, in such cases the judge must force the husband either to return or to divorce. But the realization of oppression, the assertion of hardship and discomfort, the superintendence of judge over refusenik, the priority of abandoning amenity over forsaking alimony, and the priority of divorce of suspense over divorce by an impotent husband are considered as some of the grounds on which the rights of suspended wife can be enforced by the ruler through coercion to divorce, legal divorce, or termination of marriage.
