Abstract:
Chose in possesion and chose in accion Rights with their dividers as the basees of Roman-German law systems in Iran's law are not stipulated, but in some laws the effect of this division can be seen. Referring of jurisprudential texts to Dept brings to mind the chose in action Right and the obligation to resemble with divisions of law in France, so that lawyers, along with their obligation and requirements and their types, are inspired by the division of French law into ordinary and objective obligations. Does this matter help us to understand better the chose in action right? Since the basis of this division in its hometown of Europe is the combination of commitment and the source, its acceptance in the law of Iran under the name of Ordinary chose in action Rights (Ordinary Commitment) and Objective chose in action Rights (Objective Commitment) will cause confusion; Therefore, with a critical approach, the division of the chose in action Right into absolute and bound (limited).
