The Challenges of Restorative Justice Criminal - Legal Policy Making ,in Faced with the constitution principles

Following dissatisfaction with the penal justice system, criminal law policymakers introduced the emergence and development of the restorative justice paradigm as a contemporary vision of the penal justice system in the last quarter of the twentieth century into the research and executive literature of the criminal justice system and its common practices in the world. In this regard, in the Iranian legal system, the implementation of public policy - legislative - criminal, requires attention to the set of strategic plans in the upstream documents, including the Constitution of the Islamic Republic of Iran as the highest source of manifestation of political and judicial views. Findings show that the design of restorative justice paradigm in the criminal policy of the country faces several challenges. The present study uses the library or documentary method to identify the challenges and limitations in the formalization of restorative justice in the approach to Principles of the Constitution and the presentation of solutions, which can undoubtedly lead to greater desirability of the legislative-restorative criminal policy in the Iranian legal system. They can challenge the formalization of the ideas governing restorative justice. It is obvious that the country's public policymakers and agents of the criminal justice system in order to achieve a desirable restorative criminal policy, can recognize and overcome such challenges, Find and promote the real place of this idea in the Iranian legal system.
