A Comparative Study of the Position of Special Administrative Courts in the Judicial System of Iran and the United States

Abstract:

Administrative proceedings in relation to other types of proceedings (legal and criminal) in addition to the technical and professional aspects of the subject of administrative lawsuits, is also important for the political dimension of these lawsuits. The structure of administrative proceedings in different countries is not designed in a single way and not necessarily under the judiciary. To what extent have administrative lawsuits existed in Iran and the United States, and what is the status of the administrative litigation body in the legal system, and the need to meet the requirements of administrative lawsuits, to establish an independent structure to hear such lawsuits (independent of the judiciary or independent courts) The present study seeks to answer the above question in a descriptive and analytical manner. The ruler of the "administration" should give the governed against the administration and administrators the right to sue and file a lawsuit against the government.
