The miracle of the Holy Quran in legislating and regulating the rights of the child
One of the fundamental rights in the field of family law is the rights of the child. The protection of children’s rights has been considered in Islamic sources and the laws of countries and the Universal Declaration of Human Rights and the Convention for the Protection of the Rights of the Child. The Holy Quran has also paid attention to this issue in different places and has stated important points about the rights of the child. In this research, an attempt has been made to answer this question after conceptualizing and examining the background of children’s rights in the world and international documents and Islam. In which legal system is the foundation of the regulation and legislation of children’s rights comprehensively and completely presented without any defects or shortcomings? Therefore, the present study deals with the miracle of the Holy Quran in legislating and regulating the rights of the child in a descriptive- analytical manner. The results of this study show that the position of children’s rights and addressing all its dimensions and angles in the Qur’anic teachings is more honorable and superior to the human rights system because in human rights systems such as the Convention on the Rights of the Child which is the foundation of the last human efforts of the twentieth century. One is in the international arena. Some of the basic rights of the child, such as spiritual rights, have been ignored, while the Holy Qur’an 1400 years ago paid attention to all its dimensions and angles. Therefore, it can be said that the establishment and regulation of children’s rights is comprehensively presented in the legal system of the Qur’an. In a situation where the child was not considered a human being and had a financial aspect, they were bought and sold. Most importantly, they were deprived of the most basic right, which is the right to life, and were buried alive and went through periods of humiliation and punishment. Legislation and protection of the rights of the child in such circumstances, without following the example of other legal systems, is in fact considered a scientific miracle and wonder of the Qur’an.
