Challenges of Administrative Law in Managing Health Emergencies

Abstract:

The Covid-19 virus pandemic in the country created a special emergencysituation that affected all health, economic and social sectors. Public affairsmanagement in health emergencies requires special administrative laws andregulations, and for this reason, the administrative law of the country shouldhave taken precautionary measures to establish necessary mechanisms tomanage these affairs in these circumstances. Although public healthmanagement is a category of health administrative police, however, Iran’sadministrative law has several legal gaps in this area; such as the lack of acomprehensive public health management law, ambiguity in the legal systemgoverning emergencies, lack of a specialized council in the field ofcoordination of public health management, fragmentation and organizationalparallelism, ambiguity in standards of the public service delivery, lack ofmechanisms to anticipate and prepare for future health crises. Therefore,reforms in the administrative legal system and the development of healthadministrative law are necessary for the proper management of health crises.
